The materials on this Web Site (“Site”) are provided by the Flagship Niagara League (“League”) as a service to its clients, employees and other interested persons and may be used for informational, non-commercial purposes only. You should assume that everything you see or read on the Site is copyrighted and may not be used except as provided in these Terms of Service or in the text on the Site without the express written permission of the League. The League neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with The League.

2. While the League uses reasonable efforts to include accurate and up-to-date information in the Site, the League makes no warranties or representations as to its accuracy. The League assumes no liability or responsibility for any errors or omissions in the content of the Site.

3. Your use of and browsing in the Site are entirely at your risk. Neither the League, any of its affiliates, agencies, nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITIED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY. The League also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, or images from the Site. In addition, you expressly acknowledge and agree that the League is not liable or responsible for any defamatory, offensive or illegal conduct of third parties.

4. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, requests, or the like, is, and will be treated as, nonconfidential and nonproprietary, unless otherwise specified.

5. Images of people or places displayed on the Site are either the property of, or used with permission by, the League. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

6. The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site are registered and common law Trademarks of the League and others. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of the League or such third party that may own the Trademarks displayed on the Site. Your use of the Trademarks displayed on the Site, or any other content on the Site, is strictly prohibited. You are also advised that the League will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

7. The League has not reviewed any or all of the Sites linked to the Site and is not responsible for the content of any off-Site pages or any other Sites linked to the Site. Your linking to the Site, off-Site pages or other Sites is at your own risk and without the permission of the League.

The software and technical data on this Site is subject to the laws, regulations, orders or other restrictions regarding import to, and export and re-export from, various countries, including export and re-export restrictions that may be imposed by applicable laws of the United States. By downloading or accessing software or technical data, you are agreeing not to import, export or re-export, either directly or indirectly (including transmission and shipment) except in accordance with all applicable laws, and you are accepting responsibility to determine what is necessary to assure such compliance. In particular, but without limitation, you agree not to export, re-export or provide the software or technical data:

a. to, or to a national or resident of Cuba, Iraq, Iran, Sudan, Libya, Syria, North Korea, or to any other country embargoed or restricted by the U.S. (This list of countries is current as of July 2002 but is subject to change.)

b. to anyone on the U.S. Commerce Department's Table of Denial Orders or the U.S. Department of Treasury's Specially Designated Nationals Lists, or

c. to any person or entity who has been prohibited from participating in U.S. export transactions by any agency of the U.S. Government.

You are also agreeing not to download, transfer, export or re-export the League products, technology, or software to your customers or any intermediate entity in the chain of supply if our products will be used in the design, development, production, stockpiling or use of missiles, chemical or biological weapons, or for nuclear end uses, without obtaining prior authorization from the U.S. Government.

9. The League may at any time revise these Terms of Service by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms of Service to which you are bound.

Privacy Policy

The Flagship Niagara League ("League") believes in your right to privacy and data protection. We have created this statement with your needs in mind.

The following topics address our information gathering abilities, our philosophy on handling personal data, and our privacy practices.

Data Collection

The Web Site (“Site”) collects data through a feedback form that allows users to request information about the League and its products and services. For this purpose we request and collect user's contact information, consisting of name, company, mailing address, e-mail address, telephone number, and fax number. The form also allows a user to provide such other information as he or she may desire to provide. Information so collected is used solely for the purpose of responding to the request of the user.

We may use user IP addresses to help diagnose problems with our server and administer our Site, to analyze trends, to track user movement and use, and to gather broad demographic information. Such data is not linked to any personally identifiable information. Personal information provided by the user may also be collected for the purposes of internal marketing research, user trend studies, and Site-wide improvements. Such data will not be shared with third parties and is used solely to improve our understanding of our audience.

Data submitted to the Site may be transferred within the League, including to subsidiaries and approved third parties strictly in order to fulfill or expedite a user's request. Data submitted to this Site will not be shared or sold to any other outside parties, unless specifically requested by the user.

Cookies

Periodically, the FlagshipNiagaraLeague.org team will collect non-personally identifiable information from people who visit the Site for the purpose of improving user experience and to facilitate the transfer of data between the Site and the individual. We do this by using cookies – a small piece of data that our Site sends to a person's computer where it is stored. For example, FlagshipNiagaraLeague.org might use a cookie to identify a person interested in a product and the next time that person visits the Site, the previously viewed product will automatically populate the screen. The cookies that FlagshipNiagaraLeague.org uses are strictly for improving overall user experience and Site performance. If people do not want to accept cookies, they can disable them by working with their settings in their browsers.

Retention of Personal Information

FlagshipNiagaraLeague.org will retain data submitted to the Site for as long as it is needed to fulfill a user’s request, maintain records of interaction with users, and/or to facilitate and support the use of registration.

Protection against Misuse of Personal Information

This Site has security measures in place to protect the loss, misuse, and alteration of the information under our control. Any League employee who may have access to such information is aware of the League Privacy Policy through direct notification and training. Access to such information is limited to those required to fulfill the applicable user request, and security procedures in place include password protection and, as appropriate, physical protection.

Notification of Privacy Policy Changes

In the event of any changes by the League of its League Privacy Policy that may impact the practices described on this Site will be posted on this Site. In no event will any such changes to this Policy apply with respect to data previously collected through this Site.

Policy on Data Collection from Juniors (under the age of 13)

We do not intentionally invite data from Juniors (under the age of 13) to this Site, but where we are aware of such submissions for educational purposes, we will treat such data as “Sensitive Data.” Data known to be from Juniors and which is not specifically submitted for educational purposes will be deleted.
